In pursuance to the previous order passed by this Court, Ms.Rishu Mishra, Advocate has filed an affidavit of the opposite party which is taken on record.

It has also been stated by Ms.Rishu Mishra, Advocate that an amount of Rs.12,26,882.44 has been paid to the applicant. However, it has been stated in the affidavit that the representation of the applicant could not be decided as referred in the order passed by the Writ Court because no fresh representation was filed by the applicant and the documents necessary to verify the claim of the applicant were not submitted before the opposite party.

It would serve no purpose to keep the present Contempt Application pending.

The contempt application is disposed of with the following directions:

The applicant shall be personally present in the office of the Executive Engineer, Purvanchal Vidhyut Vitran Nigam Limited., Varanasi on 20.3.2025 and shall submit all the necessary documents on which he relies for his claim which shall be verified by the Executive Engineer within two weeks thereafter. Appropriate orders shall be passed by the Executive Engineer after verification of the claim.

The amount found due to the applicant shall be paid within two months thereafter by the Director (Finance) Purvanchal Vidhyut Vitran Nigam Limited., Varanasi. In any case the exercise shall be completed by 30.6.2025.

In case, the applicant fails to appear before the opposite party as noted above, the opposite party shall be at liberty to pass appropriate orders ex parte after considering the

documents available in the office of the Executive Engineer.

On failure of the opposite parties to make payment of the amount due to the applicant, in case, the applicant submits the documents necessary for verification of his claim as noted above, the applicant shall be at liberty to file a fresh contempt application.

The application is disposed of.
