The present contempt applicant has been preferred for alleged non-compliance of order dated 19.07.2024 in Matter Under Article 227 No.3266 of 2024, the relevant extract of the order is quoted hereinbelow:

"6. Considering the facts and circumstances of the case, without entering into the merits, respondent no.1-Sub-Divisional Magistrate, Tehsil Alapur, District Ambedkar Nagar to decide the recall application dated 27.10.2023 as well as Case No. T 20210404040225 (Ratanpal Verma and others vs. Lalta and others, under Section 116 of the U.P. Revenue Code, 2006,, expeditiously, say within a period of three months from the date of production of computerised/certified copy of this order, in accordance with law, if there is no legal impediment.

7. It is further directed that the parties to the case shall cooperate in expeditious disposal of the case and shall not seek any unnecessary adjournment, neither any such adjournment shall be granted by the Court concerned, except in exceptional circumstances.

8. With above observations/directions, the writ petition stands disposed of. "

Sri Prabhat Tiwari, learned counsel for the respondent on the basis of instruction received from the respondent has submitted that in pursuance of the order dated 19.07.2024, the recall application has been decided by order dated 28.01.2025, photocopy of the same has been placed before the court, which is taken on record.

Since the judgement and order passed by the writ court has been complied with, the present contempt petition has become infructuous and it is dismissed as infructuous.
