Hon'ble Jaspreet Singh,J . Heard learned counsel for the petitioner and Sri Anirudh Singh, learned counsel for the respondents who has filed an affidavit on behalf of Mr. Satendra Kumar, who is the District Magistrate, Varanasi.

It has been stated that a Division Bench of this Court by means of order dated 10th November, 2023 had directed the Collector Varanasi to ensure that the recovery certificate issued by the RERA Authority is duly executed.

It has been further submitted that in furtherance thereof, three properties were attached out of which two have been sold and a sum of Rs. 80,00,000/- (Eighty Lakhs) have been recovered. The one month period after the auction expires today itself and he submits that very soon the amount shall be paid into the account of the petitioner. As far as the third party is concerned, this being put to auction and the auction date is 05.08.2025.

Considering the aforesaid, let the amount already recovered be transferred into the account of the petitioner and list this matter on 18th August, 2025 along with CAPL No. 3539 of 2024 to inform the Court what has been the outcome of the auction slated for 05.08.2025.

In the meantime, it shall be open for the learned counsel for the petitioner to implead the new incumbent in the office.
