Heard Sri Zia Ur Rehman, learned counsel appearing for the applicant.

The instant contempt application has been filed alleging therein, the disobedience of the order dated 29.8.2024 passed by this Court in Writ-A No. 6825 of 2024, whereby direction was issued to decide the petitioner's representation and a further direction was issued that if the petitioner is entitled for retiral dues, then to release the entire retiral dues within a period of six weeks.

Learned counsel appearing for the applicant has submitted that a copy of the order dated 29.8.2024 passed in Writ-A No. 6825 of 2024 has been served on the opposite party on 16.10.2024 but till date neither any decision has been taken in the matter nor the post retiral dues of the applicant have been released.

I have considered the submissions advanced by the learned counsel appearing for the applicant.

Issue notice to the opposite party.

List this matter immediately after service of notice, in top ten cases.

As per the office report dated 24.3.2025 based on the report of C.J.M., Lucknow, notice has already been served on the respondent but no one has put in appearance for the respondent.

In compliance of the aforesaid order, the respondent is present before this Court. However, in place of filing affidavit of compliance, application for grant of time for compliance of the court's order as well as exemption from personal appearance is filed, which is taken on record

The aforesaid application has been filed on the ground that there is financial crisis in the Corporation and the Corporation is trying to dispose of its immovable properties.

It is evident from the record that the order passed by the writ Court is not being complied with.

On the next date of listing, the respondent shall again appear before this Court for the purpose of framing of charges, in case, the affidavit of compliance is not filed in pursuance of the earlier orders.
