Present contempt petition has been preferred for alleged non compliance of the judgment and order of the Writ Court dated 04.10.2024 passed in Writ A No.9352 of 2024. The relevant extract of the said order is being quoted hereinabove:-

" 5. Therefore, without entering into merits of the issue, the petitioner is permitted to prefer a fresh representation to respondent No. 2 i.e. District Probation Officer, District Amethi taking all pleas and grounds, which are available to him/her, annexing all relevant documents which are necessary for disposal of the representation and also enclosing the earlier representation, if any, along with certified copy of this order within a period of ten days from today. If such representation is preferred by the petitioner within the aforesaid stipulated time, the authority concerned shall consider and dispose of the aforesaid representation of the petitioner by a speaking and reasoned order, strictly in accordance with law, with expedition, say within a period of six weeks from the date of receipt of such representation and thereafter communicate the decision thereof to the petitioner forthwith.

6. With the aforesaid direction, the writ petition is disposed of finally."

After arguing at some length, learned counsel for the applicant has submitted that the respondent has permitted the applicant to join on the post of Chief Protection Officer on 12.11.2024 but salary for the same has not been paid to the applicant.

On being asked where is the direction for payment of salary to the applicant by the Writ Court, he is unable to show the same.

At this stage, learned counsel for the applicant has submitted

that applicant may be permitted to withdraw the present case and the same may be dismissed as not pressed with liberty to avail the remedy, as may be permissible under the law.

Writ petition is dismissed as not pressed with liberty, as prayed for.
