Learned Standing Counsel has submitted that in compliance of interim order dated 01.02.2024, the applicants are getting monthly wages as directed by this Court and the contempt application has become infructuous and is liable to be dismissed.

On the other hand learned counsel for the applicant has submitted that the part compliance of the interim order has been made by giving wages to the applicants but the another direction of this court in special appeal while passing the interim order i.e. ' the State is also requested to consider the proposal for sanction of the posts forwarded if any, by the U.P. State Legal Services Authority expeditiously' , which has not been considered, hence the contempt is made out.

After hearing learned counsel for the parties and going through the record of the case and as per admitted case of the applicants that they are getting monthly wages, as per interim order dated 1.2.2024, hence, the interim order has been complied with. So far as the request made by the Court regarding sanction of post cannot be treated as direction of the Court, this is simply a request. Hence, no contempt is made out if no decision is taken for sanction of the posts. The special appeal is still pending and the applicants may raise their grievance in the special appeal.

In view of the above facts, circumstances and discussion made

hereinabove, the present contempt application has become infructuous and the same is dismissed as such.
