The present contempt application has been preferred for alleged noncompliance of judgement and order dated 22.07.2025 in Writ-C No.5624 of 2025, the relevant extract of the order is quoted hereinbelow:

"It is a matter of inquiry as to how after cancellation of registration, the hospital has been run, if it is so or if it is still being run. The C.M.O. should not have sat over the complaint of the petitioners dated 21.05.2025, if he had received the same. Nevertheless, let the C.M.O. concerned look into the matter now and do the needful, as per the law. As regards, the dispute, if any, between the opposite party nos. 3 and 4 with the petitioners that is a separate matter and our order shall have no bearing as to the dispute inter-se between the said parties for which they can pursue remedies prescribed in law.

The C.M.O. concerned shall ensure prompt action positively within ten days. "

Learned counsel for the applicant has submitted that despite the judgement and order passed in the writ petition whereby the Chief Medical Officer was directed to ensure prompt action positively within ten days but till date no decision has been taken on the representation / complaint of the applicant.

On the other hand, learned Standing Counsel on the basis of instruction received from the respondent has submitted that on 5.8.2025 a spot inspection of the hospital was made, which was alleged to be running as per submission of the learned counsel for the applicant and it was found

that no such hospital was running in the said building and after the submission of the report on 5.8.2025, the Chief Medical Officer had decided the representation of the applicant on 8.8.2025, copy of the same has been provided during course of argument, which is taken on record and photo copy of the same has already been forwarded to the applicant.

At this stage, learned counsel for the applicant has very fairly submitted that the judgment and order dated 22.07.2025 passed in Writ C No.5624 of 2025, has been complied with and for all practical purposes, the present contempt petition has become infructuous and the same may be dismissed as infructuous.

As such, the present contempt application is dismissed as infructuous.

Notice issued earlier, if any, stands discharged.
