Heard learned counsel for the applicant and learned Standing Counsel for the Stateopposite party.

Case was heard on 25.8.2025, Court has passed the following order:-

1. Heard Rohit Upadhyaya, learned counsel for the applicant and Sri Udit Chandra, learned counsel for opposite party.

2. Learned counsel for opposite party informed that in compliance of order of Writ Court as well as this Court dated 21.08.2025, applicant has been permitted to join his services.

3. Learned counsel for the applicant has not objected, but submitted that there is no positive order for payment of salary.

4. As the applicant has submitted his joining on 22.08.2025, therefore, in all eventuality, first current salary would only be due after completion of month i.e. 31.08.2025. Therefore, at this stage, it cannot be said that it would not be paid salary.

5. To make the facts clear, District Basic Education Officer, Mathura is directed to file personal affidavit indicating the payment of current salary only i.e. from the date of joining from month to month basis regularly unless any adverse order has been passed by Competent Court or Competent Authority within two weeks, failing which, he shall remain present before the Court on the next date fixed.

6. List this case on 10.09.2025 along with connected matter.

Pursuant to the order of this Court dated 19.5.2025, Mr. Ravindra Singh, District Inspector of Schools, Mathura is present before this Court and has filed compliance affidavit, which is taken on record. On the basis of affidavit, Mr. Udit Chandra, learned counsel for the opposite party submitted that payment of salary is under process and shall be credited into the account of applicant maximum by Ist week of

Learned counsel for the applicant raised objection and submitted that there is no averment in the affidavit to this effect.
