Learned Standing Counsel on the basis of instructions received from the respondent has submitted that the recovery certificate issued by the RERA has been returned by the respondent to the RERA for the reason the details of the property provided were not in existence and now the fresh recovery certificate is to be issued by the RERA only then it could be executed or implemented. The copy of the instructions received from the respondent has been provided during course of the argument which is taken on record and the photocopy of the same has been provided to learned counsel for the applicant today itself.

Learned counsel for the applicant has very fairly submitted that for all practical purposes, the present contempt petition has become infructuous and the same may be dismissed as infructuous.

In view of above, the present contempt application is dismissed as infructuous.
