Heard learned counsel for the applicant, learned AGA for the State and perused the record.

In the prosecution case, it is alleged that although the accused owned 0.63 hectares of land, he fraudulently sold 0.101 hectare to the complainant by committing forgery and cheating.

Learned counsel for the applicant submits that the dispute is purely civil in nature. The applicant has no criminal antecedents and is in custody since 16.04.2023. The offence is triable by the Magistrate, and the charge sheet has already been filed.

It is further submitted that there is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail.

Learned A.G.A. opposed the prayer for bail but could not dispute the aforesaid facts as argued by the learned counsel for the applicant.

Considering that the charge sheet has been filed, the offence is triable by the Magistrate, and the applicant is in custody since 16.04.2023 without any criminal history, this Court finds it a fit case for granting bail to the applicant.

Accordingly, the bail application is allowed .
