प्राथीर्गण के िवद्वान अिधवक्ता श्री अरिवन्द यादव तथा िवद्वान अपर शासकीय अिधवक्ता श्री अभय कुमार िसह को सुना तथा पत्रावली का पिरशीलन िकया।

धारा 483 भारतीय नागिरक सुरक्षा संिहता के अंतगर्त प्रस्तुत इस प्राथर्ना-पत्र द्वारा प्राथीर्गण ने मुकदमा अपराध संख्या 507 सन 2024 अन्तगर्त धारा 142 बी०एन०एस०, धारा 3 /4 ,16/17 लैंिगक अपराधों से बालकों का संरक्षण अिधिनयम , धारा 3(2) 5 SC/ST Act एवं धारा 3 / (5)1 उ०प्र० िविध िवरुद्ध धमर् संपिरवतर्न अिधिनयम थाना देवाँ िजला बाराबंकी में जमानत पर िरहा िकये जाने हेतु यह िद्वतीय जमानत प्राथर्ना-पत्र प्रस्तुत िकया है।

प्रथम जमानत प्राथर्ना-पत्र संख्या 4490 सन 2025 आदेश िदनांक 22.05.2025 के द्वारा बल न िदये जाने के आधार पर िनरस्त हो गया था।

उपरोक्त प्रकरण िदनांक 29.07.2024 को एक अज्ञात व्यिक्त के िवरुद्ध िलखाई गई प्रथम सूचना िरपोटर् के आधार पर संिस्थत हुआ िजसमें कहा गया िक अज्ञात व्यिक्त िशकायतकतार् की 17 वषीर्या पुत्री को बहला-फुसला कर भगा ले गया।

पीिड़ता ने धारा 180 भारतीय नागिरक सुरक्षा संिहता के अंतगर्त अंिकत अपने बयान में प्राथीर्गण के पुत्र गुफरान द्वारा उसको अपने साथ अपने घर ले जाना तथा धमर् पिरवतर्न करके कोटर् मैिरज करवाने का कथन िकया है। पीिड़ता ने कहा िक गुफरान ने उसकी इच्छा से उसके साथ शारीिरक संबंध बनाये।

पीिड़ता ने धारा 183 भारतीय नागिरक सुरक्षा संिहता के अंतगर्त भी ऐसा ही बयान िदया।

प्राथर्ना-पत्र के साथ प्रस्तुत शपथ-पत्र में कहा गया है िक प्राथीर्गण, जो गुफरान के माता-िपता हैं, िनदोर्ष हैं, उनका कोई पूवर् आपरािधक इितहास नहीं है।

िवद्वान अपर शासकीय अिधवक्ता ने प्राथर्ना-पत्र का िवरोध करते हुए कहा िक िववेचना में आरोपों की पुिष्ट होने के पश्चात आरोप-पत्र िदनांक 07.04.2025 को प्रस्तुत िकया जा चुका है।

आवेदकगण प्रत्येक को िनम्निलिखत शतोर्ं के अधीन संबंिधत मिजस्ट्रेट / न्यायालय की संतुिष्ट के अनुसार एक व्यिक्तगत बंधपत्र और समान रािश की दो जमानतें प्रस्तुत करने पर उपरोक्त मामले में जमानत पर िरहा िकया जाए: -

(i) आवेदकगण अिभयोजन साक्ष्य के साथ छेड़छाड़ नहीं करेंगे;

(ii) आवेदकगण अिभयोजन पक्ष के गवाहों पर दबाव नहीं डालेंगे;

(iii) आवेदकगण ट्रायल कोटर् द्वारा तय की गई प्रत्येक तारीख पर उपिस्थत होंगे।
