Heard Sri Surya Prakash, the learned counsel for the applicant as well as Sri Jayant Singh Tomar, the learned A.G.A.-I for the State and perused the record.

The instant application has been filed seeking release of the applicant on bail in Case Crime No. 395/2024, under Sections 115(2), 131, 132, 352, 351(2), 121(2) B.N.S., Police Station Paliya, District Lakhimpur Kheri.

The aforesaid case has been registered on the basis of an F.I.R. lodged on 09.12.2024 against four persons, including the applicant, stating that the accused persons were cutting trees in a reserve forest and when the Forest officials tried to catch them, they attacked the various officers causing injuries to them.

In the affidavit filed in support of the bail application, it has been stated that the applicant is involved in a range case in which he has been granted bail. All the other named accused persons have been granted anticipatory bail in the present case.

The State has filed a counter affidavit annexing therewith copies of material collected during investigation and a copy of the charge sheet dated 11.06.2025.

6. The applicant has filed a rejoinder affidavit.

All the other co-accused persons, namely, Gulshan, Kulwinder and Govnid have been granted anticipatory bail by means of orders dated 01.05.2025, 07.05.2025 & 19.05.2025 passed by a coordinate Bench of this Court in Criminal Misc. Anticipatory Bail Application Nos. 390 of 2025, 421 of 2025 & 480 of 2025 respectively.

Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that the FIR levels similar allegations against four co-accused persons, three of whom have been granted anticipatory bail; that the applicant is languishing in jail since 05.06.2025 whereas the investigation already stands concluded, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail.

Accordingly, this bail application stands allowed .

Let the applicant- Sachin @ Dablu be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to the following conditions: -

(i) the applicant shall not tamper with the prosecution evidence;

(ii) the applicant shall not pressurize the prosecution witnesses;

(iii) the applicant shall appear on each and every date fixed by the trial court.
