Heard learned counsel for the applicant, learned A.G.A. and perused the record.

It is evident from the record that notice is already served on the complainant, but none appeared on her behalf. Thus, this case is being decided with the assistance of learned counsel for the applicant and learned A.G.A.

This second bail application has been filed by the applicant in F.I.R. No. 277 of 2021, under Section 376AB I.P.C. and Sections 5k, 5m, 6 POCSO Act, Police Station Fardhan, District Kheri with the prayer to enlarge him on bail.

Learned counsel for the applicant submits that the applicant has falsely been implicated in the present case. It is further submitted that the applicant is in jail since 06.10.2021 and till today, the trial has not been concluded. It is also submitted that all the witnesses of fact have already been examined and, therefore, there is no possibility of tampering of any evidence. In such circumstances, the applicant may be enlarged on bail. The applicant is ready to cooperate in the trial.

Learned A.G.A. opposes the prayer of the applicant and submits that the victim is a deaf and dumb minor girl and the medico legal report also supports the prosecution version. It is, thus, submitted

that the applicant is not entitled for bail.

Considering the arguments advanced by the learned counsel for the applicant, learned A.G.A. and going through the contents of the application, F.I.R. as well as other relevant documents, including the medico legal report, no case for bail is made out.

The application stands dismissed.

However, trial court is directed to conclude the trial expeditiously, without giving any unnecessary adjournments to either of the parties.
