Shri Prem Chand Dwivedi, learned counsel for the applicant has pressed this second bail application primarily on the ground that the trial of the applicant is proceeding at snail's pace. He further submits that the applicant is incarcerated in jail since 19.07.2024. Charges have already been framed against the applicant vide order dated 27.11.2024 and thereafter the case is being fixed for prosecution evidence. However, till date none of the witnesses have been examined and various dates are being fixed recording the fact that witnesses have not appeared.

On specific query being put forth as to what is the current status of the trial learned counsel for the applicant has invited the attention of this Court to the order sheet of the proceedings brought on record as Annexure 3 to the affidavit filed in support of the bail application to submit that on all the dates fixed the witnesses have not been appearing. Order sheet up to 25.09.2025 is on record. However, near about three months have passed by and the counsel for the applicant has been unable to apprise the Court as to what has transpired after 24.09.2025.

In such view of the matter the Court is of the opinion that the applicant may bring on record the current status of the trial proceedings by filing the order sheet of the proceedings by way of an affidavit.

List this case, along with the records of the previous bail application, as fresh on 08.01.2026.
