Heard Shri Chandan Srivastava, learned counsel for the applicant, Shri Ashok Kumar Srivastava, learned A.G.A. for the State and perused the records.

The instant application has been filed seeking release of the applicant on bail in Case Crime No.1410 of 2019 under Sections 409/419/420/467/468/471/120-B I.P.C. registered at Police StationGomti Nagar, District- Lucknow.

The aforesaid case has been registered on the basis of an F.I.R. alleging that the informant had made investments in Shine City but no returns were paid on the investments.

The applicant used to work as an agent for the company and he was neither a director nor any principle position holder in the company.

The applicant is involved in 20 other cases of similar nature and he has been granted bail in three cases.

The State has filed a counter affidavit opposing the bail application.

Having considered the aforesaid facts and circumstances of the

case and keeping in view the fact that FIR has been lodged after nonreturn of investment in a Company; the applicant was neither a Director nor any principle position holder in the Company; that the applicant has been granted bail in three other cases of similar nature and he is languishing in jail since 24.12.2024 and as per the statement made by the learned counsel for the applicant that even charges have not been framed till date, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail in the aforesaid case.

Accordingly, this bail application stands allowed .

Let the applicant- Ravi Kant Tiwari be released on bail in the aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to following conditions:-

(i) the applicant shall not tamper with the prosecution evidence;

¶20

(ii) the applicant shall not pressurize the prosecution witnesses;

¶21

(iii) the applicant shall appear on each and every date fixed by the trial Court.
