Bablu Jaat @ Vikas vs State of U.P.

Instant bail application has been filed with a prayer to release the applicant on bail during the trial in Case Crime No. 712 of 2024, under Sections 191(2), 191(3), 190, 115(2), 109, 351(3), 352 BNS, Police Station- Sadar Bazar, District Agra.

Contention of learned counsel for the applicant is that the applicant has been falsely implicated on the basis of general and vague allegation. It is further submitted that no role has been assigned to the applicant for causing injury to the injured and even injured has also not identified the applicant. He further submitted that charge sheet has been filed by the police, therefore, there is no requirement for custodial interrogation. The applicant is languishing in jail since 27.12.2024. In case, he is granted bail, he will not misuse the liberty of bail and would cooperate in the trial proceedings.

Per contra, learned A.G.A. for the State vehemently opposed the prayer for bail and submitted that during investigation the injured victim identified the applicant from his photograph available in the mobile which was recovered on the spot and clearly stated that this is the person who had fired on him which resulted into fire arm injury. It is further submitted that even the owner of the vehicle Saurav Singh himself stated that it is the applicant Bablu Jaat @ Vikas, who has taken his vehicle which was used at the time of incident, therefore, the applicant is not entitled to be released on bail.

Thus, considering the entire facts and circumstances of the case, submissions of learned counsel for the parties and taking into account the fact that the injured victim himself identified the present applicant through his

photograph available in his mobile which was recovered on the spot, couple with the statement of owner of vehicle, applicant is not entitled to be released on bail, at this stage.

Accordingly, the present bail application is rejected .
