HIGH COURT OF JUDICATURE AT ALLAHABAD (Dr. Gautam Chowdhary, J.), Crl. Misc. Bail Application No. 34036 of 2025, Dinesh v. State of U.P., decided October 14, 2025 — ALLOWED. Applicant, booked in Crime No. मु.अ.सं० 255/2025, P.S. Sahaswan, District Budaun, under Ss. 69/351(3) BNS on a complaint dated 18-06-2025 by a divorced woman that he kept her on a false promise of marriage, had forcible physical relations with her (locally and in Surat) and took about Rs. 4,32,500 of her money, and in custody since 01.07.2025, sought bail. His counsel contrasted the FIR with her S. 183 BNSS statement (married Parveen Yadav in 2005; two children; separation in 2024) to contend she was a consenting party fully aware he was married with two children, relying on Mahesh Damu Khare v. State of Maharashtra, 2024 SCC OnLine SC 3471 (paras 26, 27, 31: prolonged unprotested physical relationships indicate consent, not misconception of fact, and attaching criminality to soured long-term relationships at a belated stage is dangerous). The Additional Government Advocate opposed, submitting the offence was cognizable and grave. सूची पुनरीिक्षत वतर्मान दािण्डक प्रकीणर् जमानत प्राथर्ना पत्र, आवेदक की ओर से मु.अ.सं० 255/2025 अन्तगर्त धारा 69/ 351(3) बी.एन.एस., थाना सहसवान, िजला बदायूं में जमानत पर मुक्त करने हेतु प्रस्तुत िकया गया है।

आवेदक के िवद्वान अिधवक्ता एवं िवद्वान अपर शासकीय अिधवक्ता को सुना तथा पत्रावली का पिरशीलन िकया।

संक्षेप में अिभयोजन कथानक के अनुसार वािदनी मुकदमा द्वारा क्षेत्रािधकारी सहसवान, िजला-बदायूँ को िदनांक 18-06-2025 को इस आशय का प्राथर्ना पत्र िदया गया िक वािदनी / पीिडता पुत्री रघुवीर िन० ग्राम डकारापुख्ता थाना सहसवान जनपद बदायूँ की रहने वाली है। पीिड़ता की शादी लगभग अब से 18 साल पूवर् परवीन के साथ हुई थी। िजससे आपसी लड़ाई झगडे में तलाक हो गया था। पीिड़ता के तलाक के बाद अपने ग्राम डकारा पुख्ता चली आयी तभी पीिड़ता की मुलाकात िदनेश पुत्र फूल िसह िन० डकारापुख्ता थाना सहसवान जनपद बदायूँ से हुई जो अब से करीब एक साल पूवर् शादी का झांसा देकर पीिड़ता को मो० अकबराबाद, कस्बा व थाना सहसवान जनपद बदायूँ िकराये के मकान में लेकर आ गया तथा पीिड़ता के साथ जबरदस्ती शारीिरक सम्बन्ध बनाये कहा िक शादी कर लेंगे। िफर पीिड़ता को सूरत शहर ले गया वहाँ भी शादी का झांसा देकर शारीिरक सम्बन्ध बनाता रहा व मेरे भाई को जान से मारने की धमकी देते हुए मेरा एक प्लाट जो िक रजपुरा में था िजसे उसने मुझसे अंकन 6 लाख 60 हजार रूपयो में िबकवा िदया िजससे पीिडता अपना खचार् करती थी तथा कुछ कपड़ा कम्पनी में काम करते हुए उससे अपना बाकी खचार् करके अपनी गृहस्थी चला रही थी। परन्तु उसमें से भी िदनेश ने तकरीबन अंकन 4 लाख 32 हजार पाँच सौ रूपये बहला फुसलाकर ले िलये थे और उसने वह रूपया अपने गाँव में िभजवाया था। घटना िदनांक 04.06.2025 की है।

आवेदक के िवद्वान अिधवक्ता ने तकर् प्रस्तुत िकया िक आवेदक को इस प्रकरण में गलत एवं फजीर् ढंग से झूठा फंसाया गया है, उसने किथत अपराध कािरत नहीं िकया है। पीिडता द्वारा प्रथम सूचना िरपोटर् में कथन िकया गया िक आवेदक उसे करीब एक साल पूवर् शादी का झांसा देकर पीिड़ता को मो. अकबराबाद, कस्बा व थाना सहसवान जनपद बदायूं िकराये के माकान में रखा और उसके साथ जबरदस्ती शारीिरक संबंध बनाया। जबिक पीिड़ता ने बयान अंतगर्त धारा 183 बी.एन.एस.एस. में कथन िकया िक मेरी शादी 2005 में परवीन यादव के साथ हुई थी। मेरे दो बच्चे है। िदनेश मेरे गाँव का ही है। िदनेश ने मेरे पित को भडकाया और मेरा और मेरे पित का 2024 में तलाक हो गया। मैं अपने मायके आ गयी। मायके आने पर िदनेश कहने लगा िक जहाँ तू रहती है, वहाँ लेकर चलूगा। में िदनेश के साथ सूरत चली गयी। क्योिक िदनेश ने मुझसे कहा था िक शादी करेगा।

उक्त प्रथम सूचना िरपोटर् एवं पीिड़ता के बयान अंतगर्त धारा 183 बी.एन.एस.एस. के अवलोकन से यह प्रतीत होता है िक पीिड़ता एक सहमत पक्षकार है। चूिक वािदनी का आवेदक के गाँव में मायका है तथा आवेदक के पािरवािरक िस्थित के बारे में वािदनी को पूरी जानकारी पहले से थी की आवेदक शादीशुदा व 2 बच्चों का िपता है। इसिलए आवेदक पर उपरोक्त अंतगर्त धारा 69 बी.एन.एस. का आरोप नहीं बनता है। वािदनी द्वारा यह भी कथन है िक आवेदक शादी का झांसा देकर दुष्कमर् करता रहा जो िक िबल्कुल झूठा व बनावटी है। आवेदक का कोई आपरािधक इितहास नहीं है। आवेदक के िवद्वान अिधवक्ता द्वारा अपने तकोर्ं के समथर्न में न्यायालय का ध्यान उच्चतम न्यायालय द्वारा िनणीर्त Mahesh Damu Khare Vs. The State of Maharastra and another reported in 2024 SCC On Line SC 3471 , उक्त आदेश में विणत खण्ड प्रस्तर 26, 27 एवं 31 की तरफ आकृष्ट कराया,

In the present case, the nature of relationship between the appellant and the complainant can be characterised by the following attributes:

(i) The appellant and the complainant were acquainted with each other since 2008. The complainant herself admits that the appellant has been in physical relationship since then till 2017 without protest in spite of alleging that the appellant had done so without her consent.

(ii) The physical relationship was going on routinely. But the complainant in her complaint states that after she got a rented room in Shirvane, Nerul Sector 1, Navi Mumbai, in December,

(iii) 2010, the appellant used to come every day and had sexual intercourse everyday, though without her consent and by giving false promise of marriage. The complainant does not appear to be a naive and gullible woman who was susceptible to deceit while maintaining physical relationship with the appellant and the allegation of false promise

surfaced only when the appellant refused to provide further financial and other assistance.

27.The conduct of the complainant clearly shows that she is a mature person clearly capable of understanding the consequences of her acts and she was fully aware of the kind of illicit relationship she was maintaining with a married person. The complainant was fully aware that the appellant was already married and had two wives, though one of them was not keeping well. Thus, from the above it appears that it is more of an extramarital affair during the aforesaid period without any insistence by the complainant for getting married to the appellant. The fact that the complainant continued to have a physical relationship for a long time without any insistence on marriage would indicate the unlikelihood of any such promise made by the appellant for marrying her and it rather indicates that the relationship was a consensual one.

In our opinion, the longer the duration of the physical relationship between the partners without protest and insistence by the female partner for marriage would be indicative of a consensual relationship rather than a relationship based on false promise of marriage by the male partner and thus, based on misconception of fact.

31.In our view if criminality is to be attached to such prolonged physical relationship at a very belated stage, it can lead to serious consequences. It will open the scope for imputing criminality to such long term relationships after turning sour, as such an allegation can be made even at a belated stage to drag a person in the juggernaut of stringent criminal process. There is always a danger of attributing criminal intent to an otherwise disturbed civil relationship of which the Court must also be mindful.

पुनः उनका कथन है िक आवेदक की ओर से यह आश्वासन िदया गया है िक वह कानून की प्रिक्रया में सहयोग करने के िलए तैयार है और जब भी आवश्यकता होगी वह ईमानदारी से अदालत के समक्ष खुद को उपलब्ध कराएगा और उन सभी शतों को स्वीकार करने के िलए भी तैयार है जो न्यायालय उस पर अिधरोिपत करेगी। आवेदक िनदोर्ष है तथा वह इस प्रकरण में िद० 01.07.2025 से कारागार में िनरुद्ध है इसिलए आवेदक को जमानत पर छोड़ िदया जाय।

िवद्वान अपर शासकीय अिधवक्ता ने आवेदक के िवद्वान अिधवक्ता के तकोर् का प्रबल िवरोध करते हुए तकर् प्रस्तुत िकया िक आवेदक द्वारा कािरत अपराध संज्ञेय एवं गंम्भीर प्रकृित का है ,

इसिलए आवेदक को जमानत पर न छोड़ा जाये।

आवेदक के िवद्वान अिधवक्ता के तकोर्ं के पिरप्रेक्ष्य प्रश्नगत प्रकरण में पत्रावली पर उपलब्ध सारवान तथ्यों एवं पिरिस्थितयों का समग्र रूप से अवलोकन करने के बाद , सबूतों की प्रकृित और िकसी भी ठोस िवरोधात्मक सामग्री की अनुपिस्थित एवं उपलब्ध सामग्री से छेड़छाड़ की संभावना न होने के तथ्य को देखते हुए मेरी राय में आवेदक को जमानत पर मुक्त करने का उपयुक्त आधार है।

अतः वाद के गुण दोष पर िबना कोई िटप्पणी िकए हुए आवेदक को उपरोक्त विणत अपराध में संबंिधत न्यायालय की सन्तुिष्ट पर व्यिक्तगत बंध - पत्र एवं अिधक धनरािश के दो स्थानीय प्रितभू प्रस्तुत करने पर िनम्निलिखत शतोर्ं के साथ जमानत पर छोड़ िदया जाय

आवेदक िववेचना या परीक्षण के दौरान अिभयोजन साक्ष्यों के साथ छेड़छाड़ नहीं करेगा।

आवेदक अिभयोजन सािक्षयों व पीिड़ता / िशकायतकतार् को डरायेगा / धमकायेगा नहीं।

आवेदक न्यायालय के आदेशों का पालन करेगा , वह परीक्षण के दौरान िबना कोई अनावश्यक स्थगन िलए िनयत ितिथ पर न्यायालय में उपिस्थत होगा तथा परीक्षण में ईमानदारी से सहयोग करेगा।

आवेदक जमानत पर िरहा होने के बाद जमानत की स्वतंत्रता का दुरूपयोग नही करेगा और िकसी भी अपरािधक गितिविध में िलप्त नहीं होगा न कोई अपरािधक कृत्य करेगा।

आवेदक प्रत्यक्ष या अप्रत्यक्ष रूप से मामले के तथ्यों से पिरिचत िकसी भी व्यिक्त या पुिलस अिधकािरयों को कोई प्रलोभन या धमकी नहीं देगा न ही उनसे कोई वायदा करेगा, िजसके कारण उन्हें न्यायालय में तथ्यों को उजागर करने से िवरत रहना पडे़।

उपरोक्त शतोर्ं में से िकसी के उल्लंघन के मामले में , परीक्षण न्यायालय आवेदक की जमानत िनयमानुसार रद्द करने को स्वतंत्र है।
