Heard Sri Saurabh Sachan, learned counsel for applicant and Sri Bhupendra Pal Singh, learned AGA for State.

This is second bail application filed by applicant-Amit Kumar in Case Crime No. 355 of 2022, under Sections 376, 342, 452, 506 IPC, Police Station Sajeti, District Kanpur Nagar. First bail application of applicant was disposed of vide order dated 24.05.2024.

I have perused the statement of victim which is consistent against applicant, therefore, any submission at this stage on behalf of applicant that victim was not mentally fit for cross examination cannot be accepted since it has been specifically endorsed that an application was filed seeking adjournment for cross-examination which was dismissed and opportunity of cross-examination was closed. Otherwise also, trial is at the fag end.
