Sri S.K. Tiwari, learned counsel for applicant seeks further time to file statement of material witnesses.

However, after perusing the order sheet, it appears that this application is pending for sufficient time and till date learned counsel for applicant has not filed such statement.

Court also takes note of status report that out of 23 prosecution witnesses, 5 have been examined.

Taking note of above circumstances, this bail application is rejected . However, a liberty is given to applicant to file fresh bail application along with statement of material witnesses.

Concerned Superintendent of Police is also directed to ensure that all police witnesses shall remain present before the learned trial Court as and when summon is issued.
