Heard Sri Satish Pandey, learned counsel for the applicant and Sri Ashutosh Singh, learned A.G.A. for the State-respondent.

The instant bail application has been filed seeking release of the applicant on bail in Case Crime No.0084 of 2024, under Sections 409, 420, 467, 468, 471, 120-B IPC, Police Station Chilhiya, District Siddhartha Nagar, during pendency of the trial.

Learned counsel for the applicant submits that applicant was not named in the FIR and FIR of the present case was lodged against co-accused Amit Kumar Shukla and Ramujagir Shukla with the allegations that they misappropriated the fund related to sale of paddy but during investigation with the aid of Section 120-B I.P.C. applicant has been made accused in the present matter.

He further submits that applicant is having no concern with the alleged sale of paddy and he was only the transporter.

He further submits, however, apart from the present case, applicant is having criminal history of four other cases but in three cases, he has been made accused alongwith present matter and he was having previous criminal history of only one case. He next submits, entire criminal history of the applicant has been explained.

He further submits that all the alleged offences are triable by Magistrate and applicant is in jail in the present matter since 10.06.2025.

Per contra, learned AGA however opposed the prayer for bail but could not dispute the arguments on facts advanced by learned counsel for the applicant.

8. I have heard both the parties and perused the record of the case.

Considering the fact that applicant was not named in the FIR and during investigation, he has been made accused with the aid of Section 120-B I.P.C. and he was only transporter and his criminal history of four cases has been explained in the instant bail application and he is in jail in the present matter since 10.06.2025 and all the alleged offences are triable by Magistrate, in my view, applicant is entitled to be released on bail.

Accordingly, without expressing any opinion on the merits of the case, the instant bail application is allowed .

Let the applicant- Mayank Mani Tripathi be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions:-

(i) The applicant shall appear before the trial court on the dates fixed, unless her personal presence is exempted.

¶18

(ii) The applicant shall not directly or indirectly, make inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or any police officer or tamper with the evidence.

(iii) The applicant shall not indulge in any criminal and anti-social activity.

¶20

In case of breach of any of the above condition, the prosecution will be at liberty to move an application before this Court for cancellation of the bail of the applicant.

It is clarified that the observations made herein are limited to the facts brought in by the parties pertaining to the disposal of bail application and the said observations shall have no bearing on the merits of the case during trial.
