Heard Sri Ajay Kr. Srivastava, advocate holding brief of Sri Prashant Ji Pandey, learned counsel for the applicant and Sri Alok Sharma, learned A.G.A. for the State.

The instant application has been filed to release the applicant on bail in case crime No. 165 of 2025, under Section 109(1) BNS, P.S. Rampur Karkhana, District Deoria.

Contention of learned counsel for the applicant is that the applicant has been falsely implicated and there is no recovery of any weapon from his possession.

Per contra, learned A.G.A. opposed the prayer and submitted that as per the injured himself the specific role of causing fire arm injury to the injured has been assigned to the applicant, therefore, no case for interference is made out.

Considering the aforesaid submissions of learned counsel for the parties and taking into account that the injured has made specific allegation against the applicant for causing fire arm injury and the bullet was also recovered from the abdomen of the injured after surgery, this Court does not find any good ground to enlarge the applicant on bail.

Accordingly, the bail application is rejected .
