Supplementary affidavit, filed by learned counsel for the applicant, is taken on record.

Heard Sri Ram Shiromani Yadav, learned counsel for the applicant and learned A.G.A. for the State.

The instant application has been filed to release the applicant on bail in case crime no. 2078 of 2009, under Sections 307, 504 IPC, P.S. Shahbad, District Rampur.

Contention of learned counsel for the applicant is that the applicant has been falsely implicated and general allegation has been made against four persons for causing fire arm injury to the injured. However, no specific role has been assigned to the applicant. It is further submitted that charge sheet has been filed in the present case, therefore, there is no requirement of custodial interrogation.

Per contra learned A.G.A. opposed the prayer and submitted that the applicant has criminal history of 16 cases which includes 7 cases of attempt to murder as well as other cases under N.D.P.S. Act and the applicant is absconding since 2009 due to which trial of this case could not be concluded. In case the applicant is released on bail, there are chances that he may commit further offence and his conduct shows that he will not cooperate in trial.

Considering the aforesaid submissions of learned counsel for the parties and taking into account that applicant has criminal history of 16 cases in which most of the cases are heinous offences, including attempt to murder and N.D.P.S. Act as well as robbery and as the applicant also remained absconding for more than 15 years and ensuring presence of the applicant during trial also appears to be difficult, just to prevent the applicant from committing further offence and for ensuring his presence before the trial court, this Court is not inclined to release the applicant on bail.

Accordingly, the application is rejected .

As the session trial of the present case itself is pending for the last 15 years, therefore, the court below is directed to conclude the trial of this case as expeditiously as possible.
