Heard Sri Anupam Tripathi, learned counsel for the applicant, Sri Roshan Kumar Singh, learned A.G.A. for the State and perused the record.

Instant bail application has been filed with a prayer to release the applicant on bail during the trial in Case Crime No. 612 of 2025, under Sections 115(2), 352, 351(3), 109, 118(2) B.N.S., Police Station- Nigohi, District Shahjahanpur.

Contention of learned counsel for the applicant is that the applicant has been falsely implicated due to old enmity. It is further submitted that he has no criminal history and languishing in jail since 03.11.2024. In case, he is granted bail, he will not misuse the liberty of bail and would cooperate in the trial proceedings.

On the other hand, learned A.G.A. for the State opposed the prayer for bail and submitted that NCT and NCCT head of the injured shows that he has received multiple displaced fractures in walls of left maxilliary sinus as well as fractures in the inferior wall of left orbit which are grievous in nature and specific role has been assigned to the applicant for causing injury, therefore, he is not entitled to be released on bail.

Thus, considering the entire facts and circumstances of the case, submissions of learned counsel for the parties and taking into the fact that specific role has been assigned to the applicant for causing injury and as per the injury report of the injured, the injured has received multiple displaced fracture in left maxilliary sinus as well as fracture in the interior wall of left orbit, which are not only grievous in nature but also on the vital part of the body, couple with the fact that specific allegation has been made against the applicant for causing injuries, therefore, this Court is not inclined to grant bail to the applicant, at this stage.

Accordingly, the present application is rejected .
