Heard Shri Vinod Singh, learned counsel for the applicant, Shri S. K. Rai, learned AGA-I for the State and perused the record.

This bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been moved on behalf of accused-applicant, Tasleem Alias Tasneem Alias Ayan , seeking enlargement on bail in Case Crime No. 39 of 2025, under Sections 124 (1), 61 (2) (A) of the Bharatiya Nyaya Sanhita, 2023, Police Station Kotwali Dehat, District Bulandshahar.

Learned counsel for the applicant argued that the accused-applicant is innocent. He has been falsely implicated in this very case crime number and is languishing in jail since 18.1.2025. Learned counsel for the applicant submits that initially the FIR has been lodged against the unknown person. In the first statement as well as in the second statement, victim/injured has not said anything against the applicant. Rather, made allegation against coaccused Sahjad. Name of applicant surfaced on record on the basis of confessional statement of co-accused Sahjad. Learned counsel for the applicant submits that co-accused Sahjad has already been granted bail by this Court on 19.5.2025 in Crl. Misc. Bail Application No. 16139 of 2025. Learned counsel for the applicant submits that in the recovery memo, there is no mention about date and place of recovery. Charge sheet in this case has already been filed on 3.4.2025 and Trial Court has taken cognizance on 15.4.2025, but till date charges have not been framed against the applicant.

course of justice or tampering with evidence in case of release on bail. Hence, bail has been prayed for.

Learned AGA has vehemently opposed the prayer for bail by submitting that shop keeper in his statement has said that applicant had purchased acid from his shop and recovery of empty bottle has been recovered from the pointing out of applicant.

Considering all above facts and circumstances, the nature of accusations, severity of the punishment in the case of conviction and nature of supporting evidence, reasonable apprehension of tampering with the witness and prima facie case, but without commenting on merit of case, a case for bail is made out.

Accordingly, the bail application is allowed .

Let the accused-applicant, Tasleem Alias Tasneem Alias Ayan , involved in above mentioned case crime number be released on bail, on his executing a personal bond and two reliable sureties each, in the like amount to the satisfaction of the court concerned, subject to the following conditions:

The applicant will not tamper with the evidence.

The applicant will not indulge in any criminal activity.

The applicant will not pressurize/intimidate the prosecution witnesses and co-operate in the trial.
