Heard Sri Om Prakash Yadav, learned counsel for the applicant and Sri Anurag Pandey, learned A.G.A. for the State.

The instant application has been filed to enlarge the applicant on bail in case crime No. 111 of 2024, under Sections 109 B.N.S., P.S. Kadaura, District Jalaun.

Contention of learned counsel for the applicant is that the applicant has been falsely implicated by his father-in-law as he was having issue with his wife who is injured. It is further submitted that charge sheet has been filed in the present case, therefore, there is no requirement of custodial interrogation. In case, he is granted bail, he will not misuse the liberty of bail and would cooperate in the trial proceedings.

Learned A.G.A. vehemently opposed the prayer and submitted that specific allegation has been made against the applicant for causing injuries to the injured which is duly substantiated by the injury report of the injured.

Considering the aforesaid submissions of learned counsel for the parties and taking into account that specific allegation of causing head injury has been made against the applicant and the injury report shows that there is depressed comminuted fracture which is dangerous to life, this Court is not inclined to release the applicant on bail.

Accordingly, the bail application is rejected .
