The present bail application has been moved by the applicantaccused Lakhan Singh for the offence punishable under Sections 318(4), 319(2), 3(5) of B.N.S.,2023 and Section 66D of I.T. Act in Case Crime No. 59 of 2025, Police Station- Cyber Crime, DistrictAgra.

Mr. Rakesh Tripathi-I, learned advocate, appears on behalf of applicant and submits that the accused-applicant has been falsely implicated in the present case on the basis of statement made by the co-accused, who has not been charge sheeted so far. There is no direct role of the accused in the present case. The FIR has been registered on 04.03.2025 for the incident occurred between 19.01.2025 to 02.03.2025 when informant has paid Rs. 42.5 lacs on the basis of mobile calls and for investing the same in the crypto currency. The statements of Karan Singh and Vatan Singh shows that there is bank transaction carried out by the accused, which is related to cyber fraud. No incriminating material has been recovered from the accused, who has already been charge sheeted. The punishment of the offences is less then seven years.

Per contra, learned AGA submits that the charge sheet has been submitted against the accused-applicant, he has no criminal history.

This Court has taken into consideration the rival submissions made by the parties and perused the record.

Prima facie, record reveals that the accused has been charge sheeted in the case of cyber crime but there is no direct material available against the accused. As per allegation made in the FIR, informant has been duped by a lady for investing the money for purchasing of crypto currency.

Without touching the merit of the case, this Court is of the opinion that this bail application is allowed.

Let the accused applicant Lakhan Singh be enlarged on bail subject to furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned
