1.Sri Devashish Mitra, Advocate appears and submits that the accused/applicant has been falsely implicated in Special Session Trial No.267 of 2002, arising out of Case Crime No.18 of 2002, under Section 2/3 Gangster Act, Police Station Fatehganj West, District Bareilly.

Learned counsel contends that the accused-applicant has jumped the bail as the accused being labour went to other State and does not know the pendency of the case. In the gang chart, three cases are shown against the accused, out of which, in two cases the accused is acquitted and one case, he is on bail. The accused has not jumped the bail merely to prolong litigation but did not know of the pendency of the case. As such, he prays that the accused/applicant be enlarged on bail.

Learned A.G.A. has opposed the prayer for bail and submitted that accused is gangster against whom three cases are shown, though, in two cases he is acquitted and and in one case, he is on bail but absconding trial in this case for long period.

This Court has taken into consideration the rival submissions made by the parties and perused the record.

The record reveals that the accused-applicant is acquitted in two cases shown in the gang chart and one case, he is bailed out. The accused has already been granted bail in this matter but he jumped the bail.
