BAIL GRANTED — High Court of Judicature at Allahabad (Dr. Gautam Chowdhary, J.), order dated 16.09.2025 in Criminal Misc. Bail Application No. 22707 of 2025 (Smt. Maya Devi v. State of U.P.): the applicant's bail application in Case Crime No. 95/2025 under Sections 61(2)/238 BNS, P.S. Kuwargaon, district Badaun, was allowed. As submitted by counsel, the deceased Veerbhan was the applicant's own younger son, and the applicant was in jail since 25.05.2025. Counsel urged that the matter rested on circumstantial evidence, that no direct or indirect evidence existed on record against the applicant, that per the case-diary (CD-5) disclosure Bhagwan Das and his wife Somvati had killed Veerbhan, that the body was carried in an e-rickshaw by Bhagwan Das along with his mother (the applicant) and wife and hidden near the railway line before Ghatpuri railway station, and that the CDR of Bhagwan Das's mobile placed it near the body-recovery spot on 18-05-2025 between 22:10:54 and 22:11:58 hrs. वतर्मान दािण्डक प्रकीणर् जमानत प्राथर्ना पत्र, आवेिदका श्रीमती माया देवी की ओर से मु०अ०स० 95/2025, अन्तगर्त धारा 61(2)/ 238 बी.एन.एस, थाना कुंवरगांव, िजला बदायूं में जमानत पर मुक्त करने हेतु प्रस्तुत िकया गया है।

आवेिदका के िवद्वान अिधवक्ता एवं िवद्वान अपर शासकीय अिधवक्ता को सुना तथा पत्रावली का पिरशीलन िकया।

आवेिदका के िवद्वान अिधवक्ता ने तकर् प्रस्तुत िकया िक आवेिदका को इस प्रकरण में गलत एवं फजीर् ढ़़़ंग से झूठा फंसाया गया है, उसने किथत अपराध कािरत नहीं िकया है। मामला पिरिस्थितजन्य साक्ष्यों पर आधािरत है। आवेिदका द्वारा ऐसा कोई कृत्य कािरत नहीं िकया गया है। आवेिदका की उक्त वाद की घटना में मृतक वीरभान आवेिदका का सगा छोटा पुत्र था। उक्त वाद की घटना में आवेिदका के छोटे पुत्र की मृत्यु/हत्या हुई है। घटना में आवेिदका की कोई भूिमका नहीं है। आवेिदका का कोई आपरािधक इितहास नहीं है। केस डायरी के पचार्-3 में दौरान िववेचना भगवान दास व भगवान दास की पत्नी सोमवती द्वारा वीरभान को मार देने तथा भगवान दास द्वारा अपनी मां माया देवी व पत्नी सोमवती के साथ िमलकर वीरभान के शव को ई-िरक्शा में ले जाकर घटपुरी रेलवे स्टेशन के पहले रेलवे लाइन के पास िछपा देने का तथ्य प्रकाश में आना व भगवान दास के मोबाइल की सीडीआर में मोबाइल की लोकेशन िदनांक 18-05-2025 समय 22 बजकर 10 िमनट 54 सेकेण्ड बजे से 22 बजकर 11 िमनट 58 सेकेण्ड बजे तक मृतक के शव िमलने के स्थान के आसपास होना उिल्लिखत िकया गया है। इसप्रकार मृतक के शव के पास िसफर् अिभयुक्त भगवान दास के मोबाईल की सी.डी.आर होने की पुिष्ट हुई है। आवेिदका के िखलाफ िकसी प्रकार का प्रत्यक्ष या परोक्ष साक्ष्य पत्रावली पर मौजूद नहीं है। तथाकिथत घटना कािरत करने की मुख्य भूिमका भगवान दास को है। पुनः उनका कथन है िक आवेिदका की ओर से यह आश्वासन िदया गया है िक वह कानून की प्रिक्रया में सहयोग करने के िलए तैयार है और जब भी आवश्यकता होगी वह ईमानदारी से अदालत के समक्ष खुद को उपलब्ध कराएगा और उन सभी शतों को स्वीकार करने के िलए भी तैयार है जो न्यायालय उस पर अिधरोिपत करेगी। आवेिदका िनदोर्ष है तथा वह इस प्रकरण में िद० 25.05.2025 से कारागार में िनरुद्ध है इसिलए आवेिदका को जमानत पर छोड़ िदया

िवद्वान अपर शासकीय अिधवक्ता ने आवेिदका के िवद्वान अिधवक्ता के तकोर् का प्रबल िवरोध करते हुए तकर् प्रस्तुत िकया िक आवेिदका द्वारा कािरत अपराध संज्ञेय एवं गंम्भीर प्रकृित का है, इसिलए आवेिदका को जमानत पर न छोड़ा जाये।

आवेिदका के िवद्वान अिधवक्ता के तकोर्ं के पिरप्रेक्ष्य में पत्रावली पर उपलब्ध सारवान तथ्यों एवं पिरिस्थितयों का समग्र रूप से अवलोकन करने के बाद, सबूतों की प्रकृित और िकसी भी ठोस िवरोधात्मक सामग्री की अनुपिस्थित एवं उपलब्ध सामग्री से छेड़छाड़ की संभावना न होने के तथ्य को देखते हुए मेरी राय में आवेिदका को जमानत पर मुक्त करने का उपयुक्त आधार है।

अतः वाद के गुण दोष पर िबना कोई िटप्पणी िकए हुए आवेिदका को उपरोक्त विणत अपराध में संबंिधत न्यायालय की सन्तुिष्ट पर व्यिक्तगत बंध-पत्र एवं उसी धनरािश के दो प्रितभू प्रस्तुत करने पर िनम्निलिखत शतोर्ं के साथ जमानत पर छोड़ िदया जाय।

आवेिदका िववेचना या परीक्षण के दौरान अिभयोजन साक्ष्यों के साथ छेड़छाड़ नहीं करेगी।

आवेिदका अिभयोजन सािक्षयों व पीिड़ता/ िशकायतकतार् को डरायेगी/धमकायेगी नहीं।

आवेिदका न्यायालय के आदेशों का पालन करेगी, वह परीक्षण के दौरान िबना कोई अनावश्यक स्थगन िलए िनयत ितिथ पर न्यायालय में उपिस्थत होगी तथा परीक्षण में ईमानदारी से सहयोग करेगी।

आवेिदका जमानत पर िरहा होने के बाद जमानत की स्वतंत्रता का दुरूपयोग नही करेगी और िकसी भी अपरािधक गितिविध में िलप्त नहीं होगी न कोई अपरािधक कृत्य करेगी।

आवेिदका प्रत्यक्ष या अप्रत्यक्ष रूप से मामले के तथ्यों से पिरिचत िकसी भी व्यिक्त या पुिलस अिध कािरयों को कोई प्रलोभन या धमकी नहीं देगी न ही उनसे कोई वायदा करेगी, िजसके कारण उन्हें न्यायालय में तथ्यों को उजागर करने से िवरत रहना पडे़।

उपरोक्त शतोर्ं में से िकसी के उल्लंघन के मामले में, परीक्षण न्यायालय आवेिदका की जमानत िनयमानुसार रद्द करने को स्वतंत्र है।
