Bail application ALLOWED — High Court of Judicature at Allahabad (Dr. Gautam Chowdhary, J.), Criminal Misc. Bail Application No. 22272 of 2025, decided October 7, 2025. Jaypal Rajput, in judicial custody in this case since 25.01.2025, was ordered released on regular bail in connection with FIR No. 1082/2024 under Sections 65(1)/137(2) BNS and Sections 3/4 POCSO Act, Police Station Kotwali, district as printed ('लिलतपुर'). After hearing counsel for the applicant, counsel for the opposite party and the Additional Government Advocate (who confirmed service/execution of notice on Opposite Party No. 2 dated 02.09.2025), and noting per the record cited by the applicant's counsel that Prosecution Witness No. 02 deposed that she went with Jaypal and married him of her own accord, without pressure, having been given time to decide, the Court — weighing the material facts on record, the nature of evidence, the absence of any concrete contradictory material, and the unlikelihood of tampering with the available material — found suitable grounds for bail. Expressly without commenting on the merits or demerits of the case, the Court released the applicant upon furnishing a personal bond and two local sureties each of sufficient amount, subject to five conditions: (1) no tampering with prosecution evidence during investigation/trial; (2) no intimidating or threatening of prosecution witnesses or the victim/complainant; (3) compliance with court orders, appearance on scheduled dates without unnecessary delay, and honest cooperation in the trial; (4) no misuse of the liberty of bail and no engagement in criminal activity or criminal acts; (5) no inducement, threat or promise, directly or indirectly, to any person acquainted with the facts of the case or to police officials to dissuade them from disclosing facts to the Court. On violation of any condition, the trial court is free to cancel the bail as per rules.
