वतर्मान दािण्डक प्रकीणर् जमानत प्राथर्ना पत्र, आवेदक की ओर से मु०अ०सं० 743/2024 अन्तगर्त धारा 318(4), 338, 336(3), 340(2), 61(2), 352, 309(4) भारतीय न्याय संिहता, थाना बन्ना देवी, िजला अलीगढ़़़़ में जमानत पर मुक्त करने हेतु प्रस्तुत िकया गया है।

आवेदक के िवद्वान अिधवक्ता, पिरवादी के िवद्वान अिधवक्ता एवं िवद्वान अपर शासकीय अिधवक्ता को सुना तथा पत्रावली का पिरशीलन िकया।

आवेदक के िवद्वान अिधवक्ता द्वारा पूरकशपथ-पत्र दािखल िकया गया, इसे पत्रावली पर रखा जाय।

आवेदक के िवद्वान अिधवक्ता ने तकर् प्रस्तुत िकया िक आवेदक को इस प्रकरण में गलत एवं फजीर् ढ़़़ंग से झूठा फंसाया गया है। प्रश्नगत प्रकरण में आवेदक पर अपने िहस्से से अिधक भूिम को िवक्रय करने का आक्षेप है, िकतु मामलें में प्रासंिगक तथ्य यह है िक प्रथम सूचना िरपोटर् िवलंिबत है, इसका समुिचत स्पष्टीकरण नहीं िदया गया है तथा किथत भूिम खाता सं० 63, खसरा संख्या 164 रकबा 0.9910 हे० िस्तत मौजा ऐलमपुर गिढ़़़़या में थी, िजसमें आवेदक 1/24 भाग का मािलक/स्वामी है, िजसका नाम राजस्व खतौनी में सह िहस्सेदार के रूप में अंिकत है। आवेदक को इस मामलें में िमथ्या तथ्यो ं के आधार पर अनुिचत लाभ पाने के दुराशय से नािमत िकया गया है। आगे यह भी कहा गया िक प्रश्नगत प्रकरण िदवानी प्रकृित का है तथा अिभयोगी को इस मामलें के िनस्तारण हेतु िदवानी प्रिक्रया उपलब्ध है, िकतु अिभयोगी द्वारा इस मामलें में िमथ्या तथ्यों के आधार पर आपरािधक प्रकृित का बनाया गया है। पुनः उनका कथन है िक आवेदक की ओर से यह आश्वासन िदया गया है िक वह कानून की प्रिक्रया में सहयोग करने के िलए तैयार है और जब भी आवश्यकता होगी वह ईमानदारी से िवचारण न्यायालय के समक्ष खुद को उपलब्ध कराएगा और उन सभी शतोर्ं को स्वीकार करने के िलए भी तैयार है जो न्यायालय उस पर अिधरोिपत करेगी। आवेदक िनदोर्ष है तथा वह इस प्रकरण में

िद० 20.04.2025 से कारागार में िनरुद्ध है, इसिलए आवेदक को जमानत पर छोड़ िदया जाय।

पिरवादी के िवद्वान अिधवक्ता एवं िवद्वान अपर शासकीय अिधवक्ता ने अिभयुक्त के िवद्वान अिधवक्ता के तकोर्ं का प्रबल िवरोध करते हुए तकर् प्रस्तुत िकया िक अिभयुक्त द्वारा कािरत अपराध गंभीर प्रकृित का है, इसिलए अिभयुक्त को जमानत पर न छोड़ा जाय।

उभय पक्ष के िवद्वान अिधवक्ता के तकोर्ं के पिरप्रेक्ष्य में पत्रावली पर उपलब्ध सारवान तथ्यों एवं पिरिस्थितयों का समग्र रूप से अवलोकन करने के बाद, सबूतों की प्रकृित और िकसी भी ठोस िवरोधात्मक सामग्री की अनुपिस्थित एवं उपलब्ध सामग्री से छेड़छाड़ की संभावना न होने के तथ्य को देखते हुए मेरी राय में आवेदक को जमानत पर मुक्त करने का उपयुक्त आधार है।

अतः वाद के गुण-दोष पर िबना कोई िटप्पणी िकए हुए आवेदक को उपरोक्त विणत अपराध में संबंिधत न्यायालय की संतुिष्ट पर व्यिक्तगत बंध-पत्र एवं उसी धनरािश के दो प्रितभू प्रस्तुत करने पर िनम्निलिखत शतोर्ं के साथ जमानत पर छोड़ िदया जाय।

आवेदक िववेचना या परीक्षण के दौरान अिभयोजन साक्ष्यों के साथ छेड़छाड़ नहीं करेगा।

आवेदक अिभयोजन सािक्षयों व पीिड़ता/ िशकायतकतार् को डरायेगा/धमकायेगा नहीं।

आवेदक न्यायालय के आदेशों का पालन करेगा, वह परीक्षण के दौरान िबना कोई अनावश्यक स्थगन िलए िनयत ितिथ पर न्यायालय में उपिस्थत होगा तथा परीक्षण में ईमानदारी से सहयोग करेगा।

आवेदक जमानत पर िरहा होने के बाद जमानत की स्वतंत्रता का दुरूपयोग नही करेगा और िकसी भी आपरािधक गितिविध में िलप्त नहीं होगा न कोई अपरािधक कृत्य करेगा।

आवेदक प्रत्यक्ष या अप्रत्यक्ष रूप से मामले के तथ्यों से पिरिचत िकसी भी व्यिक्त या पुिलस अिधकािरयों को कोई प्रलोभन या धमकी नहीं देगा न ही उनसे कोई वायदा करेगा, िजसके कारण उन्हें न्यायालय में तथ्यों को उजागर करने से िवरत रहना पडे़।

उपरोक्त शतोर्ं में से िकसी के उल्लंघन के मामले में, परीक्षण न्यायालय आवेदक की जमानत िनयमानुसार रद्द करने को स्वतंत्र है।
