Heard Shri Atul Verma, learned counsel for the applicant, Shri Virendra Kumar, learned A.G.A.-I for the State Shri Ram Naresh Yadav, learned counsel for the complainant and perused the records.

The instant application has been filed seeking release of the applicant on bail in Case Crime No.476 of 2024, under Sections 316(2), 319(2), 318(4), 338, 336(3), 340(2), 351(3), 61(2) of B.N.S., registered at Police Station Thakurganj, District Lucknow.

The aforesaid case has been registered on the basis of an F.I.R. lodged on 08.10.2024 against three persons, including the applicant and her husband Maan Singh, who stated that Maan Singh had taken Rs.fifty lakhs from the informant under pretext of removing illegal encroachment made on two plots of land belonging to the complainant. Thereafter Maan Singh offered to get person employed in Kalyan Singh Cancer Institute for payment of Rs.twenty lakhs per candidate and the complainant gave Rs. thirty five lakhs in cash and Rs.five lakhs through bank account for getting his nephew and nephew's wife employed in the cancer institute. Although, the names of the complainant's nephew and his wife were not included in the select list, he claims to have paid Rs.fifteen lakhs for getting his another nephew employed as a peon in Raj Bhawan. It is alleged that when the complainant demanded return of the money, the

accused persons threatened him.

In the affidavit filed in support of the bail application, it has been stated that the applicant is a woman and has no criminal history and she has been falsely implicated in the present case.

The applicant is languishing in jail since 06.02.2025, whereas the coaccused Pradeep Dubey @ Pradeep Kumar Dubey, against whom similar allegations have levelled, has already been granted bail by means of an order dated 10.01.2025 passed by a coordinate bench of this Court in Criminal Misc. Bail Application No.279 of 2025.

Learned counsel for the complainant has opposed the bail application and he has submitted that co-accused Pradeep Dubey was granted bail keeping in view the fact that he is suffering from 80% disability which factor does not weigh for the applicant.

Replying to the aforesaid objection, learned counsel for the applicant has submitted that the applicant is a woman and she is also entitled to preferential treatment keeping in view the statutory mandate contained in Section 480(1)(ii) of BNS.

Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that from the narration made in the FIR it appears that it is the informant himself, who first made attempts to dispossess some persons from his plots of land, without taking recourse to the process of law and thereafter he tried to secure public employment for his nephew and nephew's wife by illegal means and even after having failed in this endeavour, the complainant again made an endeavour to get his another nephew employed by illegal means and it is only after having failed in this endeavour that the complainant has taken recourse to the process of law; that the allegations levelled against the applicant are similar to those levelled against co-accused Pradeep Dubey, and Pradeep Dubey has already been granted bail on 10.01.2025, whereas the applicant is languishing in jail since 06.02.2025 and she is a woman, having no criminal history, I am of the view that the the applicant is also entitled to be released on bail.

Accordingly, this bail application stands allowed .

Let the applicant - Maya Devi @ Maya Singh be released on bail in the aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to following conditions:-

(i) the applicant shall not tamper with the prosecution evidence;

¶27

(ii) the applicant shall not pressurize the prosecution witnesses;

¶28

(iii) the applicant shall appear on each and every date fixed by the trial Court.
