1. Heard Sri A.K. Umrao, Advocate holding brief of Sri Vipin Gangwar, learned counsel for the applicant and Ms. Ifrah Islam, learned State Law Officer and also perused the material placed on record.

1. Applicant seeks bail in Case Crime No. 1016 of 2024, under Sections 137(2), 87, 64(1), 352, 351(2), 127(2) of BNS and Sections 3/4 of POCSO Act, Police Station - Baheri, District - Bareilly, during the pendency of trial.

1. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. He has nothing to do with the said offence as alleged in the FIR. Learned counsel has also stated that the victim is the consenting party as is evident from the fact that she had gone with the applicant all the way from Bareilly to Delhi and has not raised any alarm whatsoever. She has also stated that the applicant had slapped her but there is no visible injury on the body of the victim.
