Heard learned counsel for the applicant as well as learned AGA for the State.

The applicant seeks enlargement on bail in FIR No. 0055/2024 dated 28.02.2024, under Section 302, 201, 506 of the Indian Penal Code, P.S. - Kachhauna, District Hardoi.

Learned counsel for the applicant submits that in terms of the FIR it was alleged that the applicant who is the husband of the informant had taken his own sister by use of force and subsequently, her body was found and the applicant was framed for the offence in FIR in question. Subsequently, it was informed that informant has turned hostile and does not support the prosecution.

Learned AGA has opposed the bail application.

Considering the informant turned hostile coupled with the fact that the applicant is in custody since 29.02.2024 and has no criminal antecedent, I am of the view that the applicant is entitled to be enlarged on bail. In view thereof, the application is allowed .

Let the applicant- Sajid Ali be released on bail in aforesaid FIR/Case Crime Number subject to his furnishing a personal bond and two reliable sureties of Rs. 20,000/- (Twenty Thousand) each of the like amount with the

(a) The applicant shall execute a bond to undertake to attend the hearings;

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and
