1. Heard learned counsel for the applicant, learned A.G.A. and perused the record.

2. The applicant seeks enlargement on bail in FIR No. 296 of 2024, under sections 376(3), 452, 506 IPC, Sections 5/6 POCSO Act, P.S. Gosaiganj, District Lucknow.

3. Learned counsel for the applicant argues that in terms of FIR it was alleged that daughter of informant was a minor on 1.2.2024 when the applicant committed wrong on her because of which she became pregnant and was carrying a fetus of six months. In the statement under Section 164 Cr.P.C. the victim stated that physical relation were formed with her on four occasions. She also stated that she was in love with the applicant and initially the applicant was not willing to marry her but now he is ready and willing to marry her. It is informed that a child has already born. Learned counsel for the applicant states that in terms of statement under Section 164 Cr.P.C. even the applicant is ready and willing to marry her.

4. Learned AGA has opposed the bail application.

5. Considering the facts and circumstances and the statements, however, without commenting upon the merits of the case, the applicant who is in

jail since 1.7.2024 and has no criminal history is entitled to be enlarged on bail. In view thereof, the application is allowed.

6. Let the applicant Arun be released on bail in aforesaid FIR number on his furnishing a personal bond with two sureties of Rs.20,000/- each to the satisfaction of court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.

7. In the event of applicant resiling from the statement made before this Court it would be open for the victim to move a bail cancellation application.
