Heard learned counsel for the applicant, learned AGA and perused the record.

The accused-applicant seeks bail in FIR/Case Crime No.0487 of 2024 under sections 74, 296, 123, 64(1), 316(2) BNS and section 67 IT Act, P.S. Kotwali Nanpara, District Bahraich.

In terms of the FIR, it was alleged that the informant had started talking to the applicant, and after enticing her was taken to a hotel where wrong was committed and some videos were also made, and thereafter she was being harassed. In the statement under section 183 BNSS, the victim stated that she had gone on the false pretext of marriage and physical relations were also formed. It was admitted that she knew the applicant for the last three years. The age of the victim is around twenty one years.

Considering the age of the victim and the fact that they knew each other for the last three years, the applicant who is in custody since 27.10.2024 is entitled to bail. Thus the bail application is allowed.

Let the applicant Waseem Khan be released on bail in aforesaid FIR/Case Crime Number subject to his furnishing a personal bond and two reliable sureties of Rs.20,000/- (Twenty Thousand) each of the like amount to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
