Heard Shri Krishna Kumar Tiwari, learned counsel for the applicant, Shri Mayank Sinha, learned A.G.A. for the State and perused the records.

The instant application has been filed seeking release of the applicant on bail in Case Crime No.489 of 2020, under Sections 34, 409, 419, 420, 467, 468, 471, 504, 506 I.P.C., registered at Police Station Vibhuti Khand, District Lucknow.

The aforesaid case has been registered on the basis of an F.I.R. lodged against several accused persons, including the applicant, stating that the informant has made investments in M/s Vishwas Trading Company in which the applicant was an employee and no return was paid on the investments.

In the affidavit filed in support of the bail application, it has been stated that the applicant is innocent and he has been falsely implicated in the present case. The applicant's involvement in 31 other cases of similar nature has been disclosed in para 16 of the affidavit.

The learned counsel for the applicant has submitted that the applicant has already been granted bail in 10 other cases of similar nature and the applicant is languishing in jail since 08.06.2020 and as per his information, not even a single prosecution witness has been examined till date.

Learned A.G.A. has vehemently opposed the bail application but he could not dispute the aforesaid facts.

Having considered the aforesaid facts and circumstances of the case, I am of the view that the aforesaid facts are sufficient for making out a case for

enlargement of the applicant on bail in the aforesaid crime.

Accordingly, this bail application stands allowed .

Let the applicant - Sandeep Maitee - be released on bail in the aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to following conditions:-

(i) the applicant shall not tamper with the prosecution evidence;

(ii) the applicant shall not pressurize the prosecution witnesses;

(iii) the applicant shall appear on each and every date fixed by the trial Court.
