Heard Sri D.K. Shukla, learned counsel for the applicant and Sri Santosh Nigam, learned AGA for the State-respondent.

The instant application has been filed seeking release of the applicant on bail in Case Crime No. 31 of 2025, under Sections 103(1), 238 BNS, Police Station- Hasayan, District- Hathras, during pendency of the trial in the court below.

Learned counsel for the applicant submitted that applicant is daughter-in-law of the deceased and FIR of the present case was lodged against unknown person by the son of the deceased i.e.husband of the applicant but during investigation, he has also been made accused along with applicant. He further submitted that however, as per prosecution, applicant along with her husband i.e. informant of the case committed the murder of her mother-in-law but entire allegation levelled against the applicant is totally false.

He further submitted that except suspicion, statement of coaccused and confessional statement of the applicant, there is no other evidence against the applicant on record. He further submitted that even dead body of the deceased was recovered from gher and it was not recovered from the house, where applicant and her husband resided.

He further submitted that even from the inquest report, it reflects, informant of the case i.e. husband of the applicant, who has subsequently been made accused, was present in the inquest, which shows bona fide on the part of the applicant side.

He further submitted that applicant is lady and she is not having any criminal history and she is in jail in the present matter since

16.02.2025.

Per contra, learned AGA however, opposed the prayer for bail but could not dispute the argument on facts advanced by learned counsel for the applicant.

I have heard learned counsel for the parties and perused the record of the case.

However, applicant is daughter-in-law of the deceased and as per allegation, she along with her husband strangulated her mother-in-law but it reflects, nobody could see the real incident and it appears, as according to statements of neighbours of the applicant, relationship between applicant and deceased was not cordial one, therefore, she has been made accused in the present matter.

Further, from the FIR, it reflects, however, the same was lodged by the husband of the applicant against unknown person but during investigation, he has also been made accused along with applicant.

Record further suggests that husband of the applicant was present at the time of inquest and he was one of the inquest witness.

Further, applicant is lady and she is not having any criminal history and she is in jail in the present matter since 16.02.2025.

Therefore, considering the facts and circumstances of the case discussed above, in my view applicant is entitled to be released on bail.

Accordingly, without expressing any opinion on the merits of the case, the instant bail application is allowed .

Let the applicant- Meera Begum be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions:-

(i) The applicant shall appear before the trial court on the dates fixed, unless his personal presence is exempted.

(ii) The applicant shall not directly or indirectly, make inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court

or any police officer or tamper with the evidence.

(iii) The applicant shall not indulge in any criminal and anti-social activity.

In case of breach of any of the above condition, the prosecution will be at liberty to move an application before this Court for cancellation of the bail of the applicant.

It is clarified that the observations made herein are limited to the facts brought in by the parties pertaining to the disposal of bail application and the said observations shall have no bearing on the merits of the case during trial.
