1. Heard learned counsel for the applicant, learned AGA and perused the record.

2. The applicant seeks enlargement on bail in FIR No. 790 of 2025, under sections 61(1), 64(2)(m), 351(3) BNS, Section 67 IT Act, P.S. Kotwali Nagar, District Gonda.

3. Learned counsel for the applicant argues that in terms of FIR it was alleged that informant was married and her husband was staying outside the country. Subsequently she met the applicant who enticed her and thereafter physical relation were formed on various occasions and thereafter threats were issued by the applicant. In her statement under Section 180 BNSS the same version was reiterated.

4. Learned AGA has opposed the bail application.

5. Considering the age of the victim which is around 31 years and the fact that she is married prima facie offence under Section 64 is not made out, however, without commenting upon the merits of the case, the applicant who is in jail since 14.10.2025 and has no criminal history is entitled to be enlarged on bail. In view thereof, the application is allowed.

6. Let the applicant Mohd. Haseen Khan be released on bail in aforesaid FIR number on his furnishing a personal bond with two sureties of Rs.20,000/- each to the satisfaction of court concerned with the following

(a) The applicant shall execute a bond to undertake to attend the hearings;
