Kotwali Dehat, District Balrampur, registered under Sections 376(2)(I), 313 and 506 IPC. Per the FIR, the informant's daughter, aged about 22 years, was found two months pregnant and the abortion was alleged to have been got done at the instance of the applicant. Learned counsel for the applicant relied on the statement of the doctor (recorded along with the counter affidavit) that although the pregnancy test was positive, the ultrasound reported no pregnancy, and that the victim, aged 22 years, appeared to be mentally challenged. 1. Heard learned counsel for the applicant, learned AGA for the State; Shri Mahendra Pratap Singh, learned counsel for the informant and perused the record.

2. The applicant seeks enlargement on bail in FIR No.433 of 2024, under Section 376(2)(I), 313, 506 IPC, P.S. Kotwali Dehat, District Balrampur.

3. In terms of the FIR it was alleged that daughter of the informant aged about 22 years was lying on the cot when it was found that she was two months' pregnant and subsequently, the applicant took her and abortion was also got done at the instance of the applicant.

4. In the light of the said, learned counsel for the applicant draws my attention to the statement of the doctor which is on record alongwith the counter affidavit who stated that on the basis of an inspection although in the pregnancy test positive was shown, however, in the ultrasound, no pregnancy was reported. Age of the victim was 22 years and it appears that the victim is mentally challenged.

5. Learned AGA has opposed the bail application.

and has no criminal antecedents, the applicant is entitled to be enlarged on bail. In view thereof, the application is allowed .

7. Let the applicant Magan Verma be released on bail in aforesaid FIR number on his furnishing a personal bond with two sureties of Rs.20,000/each to the satisfaction of court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
