Allahabad High Court (Dr. Gautam Chowdhary, J., order dated 7.8.2025) allowed an anticipatory bail application under Section 438 Cr.P.C. moved by Rashid Alias Mohammad Rashid in relation to Crime No. 02/2024 registered under Sections 420, 406, 467, 468 and 471 (the accompanying penal-statute name is illegible in the digitised text and has deliberately not been guessed). The Court recalled the position of the Supreme Court in Siddharam Satlingappa Mhetre v. State of Maharashtra, (2011) 1 SCC 694, that arrest ought not to be resorted to routinely and that relevant considerations bearing on the accused's liberty must be weighed, and then, after hearing counsel for both sides and taking into account the gravity of the accusation, the applicant's apprehension and the facts and circumstances of the case, accepted the application.
