Anticipatory bail u/s 438 Cr.P.C. — REJECTED. Applicant Gangadeep Singh sought pre-arrest bail in connection with Crime No. 258/2022 under ss. 419/420/467/468/471/409 IPC, P.S. Kotwali, District Ballia, pleading innocence, absence of credible evidence against him, fear of arrest, and readiness to cooperate with investigation and abide by bail conditions. State (through G.A.) opposed. Recalling that in Siddharam Satlingappa Mhetre vs. State of Maharashtra, (2011) 1 SCC 694 the Supreme Court held that a court dealing with anticipatory bail must weigh the certainty and gravity of the accusations, the likelihood of the accused evading the judicial process, and must carefully evaluate all material against the accused and his actual role, this court nonetheless found that counsel had placed no suitable and sufficient ground; the anticipatory bail application was rejected outright and any interim order, if issued, deemed revoked.
