Heard learned counsel for the applicant and learned Additional Government Advocate appearing on behalf of opposite party no.1.

First Anticipatory Bail Application has been filed with regard to Case Crime No. 42 of 2014, under Sections 379, 411, 420 I.P.C., P.S. Maigalganj, District Lakhimpur Kheri.

Allegations levelled in the F.I.R. is that a Qualis vehicle of informant went missing in the intervening night of 6/7th January, 2014.

Learned counsel for applicant submits that applicant has been falsely implicated in the charges levelled against him. It is submitted that the first information report even otherwise has been lodged against unknown persons.

Learned Additional Government Advocate appearing on behalf of State on the basis of instructions however submits that charge sheet in the matter has already been filed on 02.03.20214 whereafter cognizance was taken but due to uncooperative attitude of applicant, non-bailable warrant has been issued against him.

Upon consideration of submissions advanced by learned counsel for the parties and looking into the nature of allegations levelled as well as recovery memo, particularly the fact that non-bailable warrant has been issued against applicant, this Court does not find any good ground to grant indulgence in the matter. However, applicant is granted liberty to approach court concerned for regular bail.

Anticipatory Bail Application is finally disposed of with aforesaid observation.
