Heared Sri Sikandar Yadav, the learned counsel for the applicant, Sri Shikhar Srivastava, the learned A.G.A for the State and Sri Shailendra Singh Rajawat, the learned counsel for the complainant.

The case is listed under the heading, "FOR REFERRAL TO THE SPECIAL MEDIATION DRIVE - MEDIATION FOR THE NATION" but the learned counsel for the parties have stated that the nature of dispute is such as may not be settled through the process of mediation.

Accordingly, the Court proceeds to decide the application on its merits.

The applicant was granted interim anticipatory bail on 18.12.2024 subject to the condition that he will make himself available for interrogation by police officer as and when required.

The State has filed a counter affidavit after serving its copy on 06.12.2024, stating that the applicant is not cooperating with the investigation and he is absconding.

The applicant has not filed a rejoinder affidavit disputing the aforesaid facts.

As the applicant has not refuted the contention of the State made in the counter affidavit that he is not cooperating with the investigation, there is no good ground to extend the interim
