Applicant Virendra Prasad Kathariya sought pre-arrest bail in Case Crime No. 414 of 2022 under S. 409 IPC and Ss. 3/7, Essential Commodities Act, 1955, Police Station Kotwali Dehat, District Balrampur. The FIR dated 27.11.2022 was lodged by the applicant himself along with co-accused Manoj Kumar alleging that paddy lying in a godam had been sold/removed, following a surprise inspection on 25.11.2022 in which physical stock was allegedly found short of book stock, and the District Supply Office godam was sealed. Departmental proceedings on the identical allegations were pending against the applicant, who had already submitted his reply, and co-accused Manoj Kumar had been granted interim bail by order dated 15.12.2023 in petition no. 2889 of 2023.
