1. Heard learned counsel for the applicant as well as learned Additional Government Advocate for State.

Notice to respondent No.2 is dispensed with, in view of the proposed order.

2. The present application has been filed seeking anticipatory bail in case crime No.353 of 2023 under section 147, 148, 149, 323, 325, 504, 506, 308 I.P.C., P.S. Gauriganj, district Amethi.

3. Learned counsel for applicant submits that the applicant has been falsely implicated due to political rivalry. He has drawn attention of the court towards the statement of Pradeep Singh, an independent eye-witness who has stated that the incident has been reported by exaggeration.

4.Learned AGA while opposing the application has submitted that cross first information reports have been lodged by both sides. Four persons have been injured. The statement of the injured corroborates the prosecution case. Role of the applicant is, prima facie, evident. It is not a case of false implication.

5.I have considered the submission, perused the record as also the statement of the injured as well as Pradeep Singh, independent witness. Pradeep Singh in his statement has stated that the incident has been video recorded. He has further stated that the accused side have indulged into beating. The trial court while rejecting the bail application has recorded the following finding

taking into account the injuries received by four injured persons :

" 5. प्रस्तुत प्रकरण में 04 व्यिक्तयों को चोटें आना कहा गया है। आघात आख्या के अनुसार वादी मुकदमा/चोटिहल राहुल िसह के शरीर पर कुल चार चोटें पायी गयी है िजसमें से तीन घोटें कन्ट्यूजन की कमशः दािहने घुटने पर 09 X 09 सेमी० आकार की, दािहने अग्रबाहु पर 08 X 07 सेमी० आकार की व िसर पर दािहने ओर 07 X 08 सेमी० आकार की व एक चोट बायें हाथ पर ददर् की िशकायत की आयी है। एक्स रे िरपोटर् के अनुसार चोटिहल राहुल िसह की दािहने पैर की टीिबया व िफबुला बोन फैक्चर पायी गयी है। चोटिहल उमेश प्रताप िसह के शरीर पर कुल दो चोटें पायी गयी है िजसमें से एक चोट कन्ट्यूजन की 07 X 04 सेमी० आकार की दािहने हाथ पर व एक चोट एवेजन की 07 X 0.2 सेमी० आकार की गले के पीछे आयी है। चोटिहल अरूणेन्द्र िसह के शरीर पर भी कुल दो चोटें पायी गयी है िजसमें से एक चोट लेसरेटेड युण्ड की 01 X 0.2 सेमी० आकार की व लेसरेशन की 06 X 07 सेमी० आकार की दािहने अग्रबाहु पर व एक चोट ददर् की िशकायत की दािहने हाथ पर आयी है। चोटिहल दीपक कुमार के शरीर पर कुल दो चोटें पायी गयी हैं. िजनमें से पहली चोट नीलगू िनशान के साथ खरोंच की चोट 04 X 05 सेमी० आकार की बांये घुटने के जोड़ पर एवं दूसरी चोट पीठ पर ददर् की िशकायत के रूप में है।

प्राथीर् / अिभयुक्त की ओर से यह तकर् प्रस्तुत िकया गया िक वादी मुकदमा द्वारा प्रस्तुत प्राथर्ना पत्र अन्तगर्त धारा 156 (3) द०प्र०सं० पर सम्बिन्धत न्यायालय द्वारा थाने से आख्या मंगाये जाने पर यह आख्या प्रस्तुत की गयी िक घटना असत्य व िनराधार है। इस सम्बन् में यह उल्लेखनीय है िक प्राथर्ना पत्र अन्तगर्त धारा 156 (3) द०प्र०सं० पर सम्बिन्धत थाने से आख्या में मात्र यह अिभकिथत करना होता है िक क्या प्रश्नगत् प्रकरण से सम्बिन्धत मुकदमा धाने पर दजर् है अथवा नहीं और इसके अलावा यिद कोई बात कही जाती है तो उसे स्वतन्त्र सािक्षयों से प्रमािणत कराना आवश्यक होता है।

यह उल्लेखनीय है िक अिग्रम जमानत प्राथर्ना पत्र में चोटों की गम्भीरता अथया अगम्भीरता नही देखी जाती है, अिपतु मात्र यह देखा जाता है िक प्राथीर्/अिभयुक्त की घटना में संिलप्तता है अथवा नहीं। प्राथीर् / अिभयुक्त प्रथम सूचना िरपोटर् में अन्य अिभयुक्तों के साथ नािमत है। प्राथीर् / अिभयुक्त पर यह आरोप है िक उसने अन्य अिभयुक्तों के साथ िमलकर यादी मुकदमा को जान से मारने की धमकी व मददी-भददी गाली देते हुए लाठी व लात मार-पीट कर व पटक कर वादी मुकदमा एवं तीन अन्य व्यिक्तयों को उक्त चोटें पहुंचायी है। वादी मुकदमा / चोटिहल राहुल िसह ने अपने बयान अन्तगर्त धारा 161 द०प्र०सं० में मार की इस घटना में प्राथीर् / अिभयुक्त की सिलप्तता का कथन िकया है।

8.उपरोक्त से स्पष्ट है िक प्राथीर्/अिभयुक्त के िवरूद्ध इस स्तर प्रथम दृष्टया साक्ष्य उपलब्ध है। ईदू

बनाम उत्तर प्रदेश राज्य, 2024 (CRIMINAL Misc. Bail Application No.-3179 of 2024) में माननीय उच्च न्यायालय, इलाहाबाद द्वारा यह िसद्धान्त प्रितपािदत िकया गया है िक अिग्रम जमानत का उद्देश्य िकसी िनदोर्ष व्यिक्त को जेल जाने से बचाना है, न िक उस व्यिक्त को जेल जाने से बचाना है िजसके िवरूद्ध कोई साक्ष्य िवद्यमान हो।

अतः मामले के समस्त तथ्यों एवं पिरिस्थितयों के दृिष्टगत मामले के गुण-दोष पर कोई अिभमत व्यक्त िकये िबना न्यायालय अिग्रम जमानत हेतु मामला उपयुक्त नहीं पाती है।"

6. In view of the above discussion as also keeping in view the statement of the injured as well as the injury reports of four injured, it cannot be said that it is a case of false implication. No case for anticipatory bail is made out. The application is accordingly rejected.

However, it is provided that in case the applicant files a regular bail application within two weeks from today, the same be decided expeditiously, strictly in view of the law laid down by Supreme Court in Satender Kumar Antil versus Central Bureau of Investigation and another Special Leave to Appeal (Cri)No.5191 of 2021 .
