1. Heard Sri Amandeep Singh, learned counsel for the applicant, learned Sri Aniruddh Singh, learned A.G.A. for the State.

2. At the very outset, learned counsel for the applicant has submitted that due to inadvertence, he could not implead the informant as opposite party in the array of opposite parties. He prays that he may be permitted to implead the informant as opposite party No. 2 with complete details in the array of opposite parties, during course of the day.

3. Issue notice to opposite party No. 2, returnable at an early date.

4. Steps be taken within a week. Office to proceed accordingly.

5. On the aforesaid request, learned counsel for the applicant is permitted to implead the informant as opposite party No. 2 in the array of opposite parties, during course of the day.

6. Learned counsel for the applicant has submitted that the applicant is apprehending his arrest in Case Crime No. 61 of 2023, under sections 409,420 & 120-B of the IPC, Police Station- Aashiyana, District- Lucknow.

At the very outset, attention has been drawn towards Annexure No. 17 which is an order dated 18.11.2024 passed by a co-ordinate Bench of this Court in CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 2559 of 2024 (Indra Prakash Pandey Vs. State of U. P.) whereby Indra Prakash Pandey, who happens to be the Director of the Company, has been granted interim anticipatory bail and the present applicant, who is an employee of the company, is also entitled for the same relief on the basis of principles of parity.

9. List and connect this case with CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 2559 of 2024 (Indra Prakash Pandey Vs. State of U. P.)

Till the next date of listing, the present applicant- Hriday Narayan, shall be released forthwith, in case of his arrest, in the aforesaid case crime number on an interim anticipatory bail on his furnishing a personal bond and two solvent sureties each in the like amount to the satisfaction of the court concerned with the following conditions:-

(i) that the applicant shall make himself available for interrogation by a police officer as and when required;

¶16

(ii) that the applicant shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer or tamper with the evidence;

¶17

(iii) that the applicant shall not leave India without the previous permission of the court;

¶18

(iv) that in case chargesheet is submitted, the applicant shall not tamper with the evidence during the trial;

¶19

(v) that the applicant shall not pressurize/ intimidate the prosecution witness;

¶20

(vi) that the applicant shall appear before the trial court on each date fixed unless personal presence is exempted;

¶21

(vii) that in case of breach of any of the above conditions the court concerned shall have the liberty to cancel the bail.

11. By the next date of listing, learned counsel for the State may file Counter Affidavit.
