Heard learned counsel for the applicant as well as learned A.G.A. for the State.

In view of the proposed order notice to opposite party no. 2 is dispensed with.

Learned counsel for the applicant by means of present application has prayed for expeditious disposal of Complaint Case No. 5203 of 2018 - Surendra Kumar Goswami Vs. Mohd. Iqbal, under Section 138 of the Negotiable Instruments Act, Police Station - Indira Nagar, District - Lucknow, pending before the Additional Court Room No. 10, Lucknow.

Learned counsel for the applicant submits that the applicant who is running a hardware shop in the name and style of M/s Goswami at Ekta Market, Geet Vihar, Mayawati Colony Sabji Mandi, Indira Nagar, Lucknow, sold pipes to the opposite party no. 2 who made payment through Cheque No. 19880200000247, dated 12.09.2018, amounting to Rs.50,000/-. The applicant presented the said cheque for encashment and same was dishonoured due to insufficient funds, hence after giving legal notice on 25.09.2018, present complaint was filed on 23.10.2018.

It is next submitted by learned counsel for the applicant that since 2018, the aforesaid case is pending consideration before the Additional Court Room No. 10, Lucknow. It is prayed that in the interest of justice, learned trial Court may be directed to conclude the proceedings of Complaint Case No. 5203 of 2018 - Surendra Kumar Goswami Vs. Mohd. Iqbal, expeditiously.

Learned Standing Counsel has no objection to the prayer made by the applicant.

In view of above, learned trial Court is directed to make every endeavour to conclude and decide the proceedings

of Complaint Case No. 5203 of 2018 - Surendra Kumar Goswami Vs. Mohd. Iqbal, under Section 138 of the Negotiable Instruments Act, Police Station - Indira Nagar, District - Lucknow, expeditiously, say within six months from the date of production of certified copy of this order, in accordance with law.
