Heard learned counsel for the petitioner and learned A.G.A. for the State.

Notice to respondent no. 2 is dispensed with in view of the proposed order.

Learned counsel for the petitioner by this petition has prayed for expeditious disposal of the complaint case (Old case) No. 42/213 "Chandra Kishor Vs. Manoj Kumar", filed under Section 138 of N.I. Act pending before the Judicial Magistrate, Kunda, Pratapgarh.

Learned counsel for the petitioner submits that the trial is of 2013. In the year 2015, it was transferred to District Kanpur and in the year 2023, it has been again transferred to Court of Judicial Magistrate, Kunda Pratapgarh. It has been further argued that the proceedings under Section 138 NI Act are liable to be concluded within a period of six months as per Section 143 (3) of N.I. Act, however, till date the matter has not been concluded. In the interest of justice, learned counsel for the petitioner requests that the proceedings be expedited.

On due consideration to the argument advanced as well as perusal of the record, so also the provisions of 143(3) of N.I. Act, in the interest of justice, learned trial court is directed to make every endeavour to conclude and decide the proceedings of aforesaid case within a period of six months from the date of production of certified copy of this order.

With the above observation, the petition stands disposed of.
