No.1598 of 2024 by informant-applicant Ramesh Yadav seeking expeditious disposal of Criminal Case No.137 of 2012 (Ramesh Vs. Ram Sringar), pending in the Fast Track Court (S.D.), Jaunpur. The case arises from the applicant's application u/s 156 (3) Cr.P.C. (Police Station Nevadhiya, District Jaunpur), ordered to be registered by the then Addl. This application under Section 483 Cr.P.C. has been filed with a prayer to direct the court concerned to decide the Criminal Case No.137 of 2012 (Ramesh Vs. Ram Sringar) under Section 156 (3) Cr.P.C., Police Station Nevadhiya, District Jaunpur pending in the Fast Track Court (S.D), Jaunpur, expeditiously within a stipulated period.

Heard learned counsel for the applicant as well as learned A.G.A. for the State.

It is submitted by the learned counsel for the applicant that the applicant is the informant of the aforesaid case. It is urged that the aforesaid case be decided expeditiously.

It appears from the perusal of the record that an application u/s 156 (3) Cr.P.C. was moved by the appellant before the court of Chief Judicial Magistrate, Jaunpur which was registered as Case No.137 of 2012 (Ramesh Vs. Ram Sringar). It further appears from the record that on the said application, an order to register the case was passed by the then Addl. Chief Judicial Magistrate, Court No.13, Jaunpur on 18.5.2012. It further reveals from the record that since the case was registered in non-cognizable sections, an application u/s 155 (2) Cr.P.C. was moved seeking permission from the court to investigate the matter in NCR No.18/12. Since then the matter is pending and no progress report has been submitted by the police. It also reveals from the perusal of the record that copy of the NCR and GD is not available from the police station. The said facts find place in the report of Incharge, Civil Judge (S.D.) / F.T.C., Jaunpur dated 23.11.2024., which is

forwarded by him to the District Judge, Jaunpur on 29.1.2025.

In the circumstances, the Court concerned is directed to conclude / decide the aforesaid matter as per law / rules within a period of two months from the date of production of certified copy of this order before it, if there is no legal impediment.
