Heard learned counsel for the applicant, learned AGA and perused the record.

The present application has been filed for the following main prayers:

"(1) To quash entire complaint case and it's proceeding of Complaint Case351/2010 (U/S 2(D) Cr.P.C.) (Annexure no-1) "Ishwerdeen Vs Ramakant & Ors" Pending before -Add. Chief judicial Magistrate Court No-16 Barabanki.

(2) To quash summoning Order dated15.02.2012, U/S - 419,420,468,471,504,506 I.P.C. (Annexure no-2) Police Station-Ramnager, District-Barabanki, passed in Complaint Case-351/2010 ( U/S 2(D) Cr.P.C.) "Ishwerdeen Vs Ramakant & Ors" Pending before - Add. Chief judicial Magistrate Court No-16 Barabanki."

Learned counsel for the applicant submits that he does not want to press this application on merits. However, he submits that the applicant will surrender before the trial court and apply for bail, which may be directed to be decided. He further submits that the applicant also wants to move a discharge application.

It is, therefore, directed that in case the applicant surrenders before the Court below within three weeks from today and prefers bail application, the trial court will decide the said bail application, in accordance with law. The
